What Oakwood Golf Course's governing documents say
This is a third amendment to the declaration of restrictions for Oakwood Golf Course, a single-family-home community in Phoenix, AZ. It is a partial document that modifies only certain terms of the full rulebook, and does not contain typical HOA rules about pets, leasing, or architectural standards. The document binds all owners of lots within the Premises and the homeowners association (Sun Lakes Homeowners Association No. 3).
- Term of restrictions: The covenants and restrictions run with the land and bind all owners until January 1, 2019. Starting December 31, 2008, the term automatically extends by one year each December 31 unless the owner(s) of the Premises record an amendment to stop the extension. The Association's signature is not required for amendments, except to allow redevelopment of the golf course.
- Golf course use & redevelopment: The Premises must remain a 27-hole golf course unless the Association consents in writing to a redevelopment that changes that use. Uses consistent with or associated with a golf course (e.g., food/beverage services, recreational facilities) are allowed without Association consent. Residential, resort, timeshare, or other housing/lodging uses are expressly not considered consistent with or associated with a golf course.
- What this document doesn't cover: This is only a partial amendment. It does not address common HOA rules such as architectural review, parking, pets, leasing, or assessments. Those rules would be found in the full Declaration and other governing documents.
