This is an amendment to the Tract Declaration for Estrella Parcel 59, a subdivision within the larger Estrella master-planned community in Goodyear, AZ. It converts Parcel 59 into a gated community with private streets and establishes a separate neighborhood assessment to fund their maintenance. The document binds all owners of lots within Parcel 59.
- Gated community & access: The developer (USD Land) will construct gates and perimeter fencing to limit vehicular public access. The Estrella Community Association (ECA) board controls gate operation and may keep gates open during certain times. Easements allow access for emergency services, utilities, refuse collection, ECA maintenance, construction contractors, real estate agents, and the developer.
- Limited common areas: Streets, streetlights, gates, entry features, fencing, and associated landscaping within Parcel 59 are designated as Limited Common Areas for the exclusive use of Parcel 59 owners, their guests, and invitees. The ECA is responsible for maintenance, repair, and replacement.
- Neighborhood assessments: All costs for operating, maintaining, repairing, and replacing the Limited Common Areas (including utilities, administrative costs, insurance premiums, and reserve fund contributions) are treated as Neighborhood Expenses assessed solely against owners of lots in Parcel 59 as a Neighborhood Assessment.
- Easements for third parties: Non-exclusive easements are granted over Parcel 59 streets for emergency services, public utilities, refuse collection, ECA maintenance, construction contractors, real estate agents, the developer (USD Land), and other service providers permitted by the ECA board.
- No security guarantee: The amendment disclaims any assurance that the gated community will provide safety or security. Owners waive all claims against USD Land, Declarant, and the ECA for any security-related damages, and acknowledge they assume all risk from third-party acts.
