Clearwater Mountain Estates is a single-family residential subdivision in Phoenix, AZ, governed by an HOA (Clearwater Mountain Estates Property Owner's Association). The CC&Rs establish rules for land use, maintenance of shared irrigation and road systems, and architectural control. Owners own their lots and a proportionate interest in the irrigation system; the HOA manages common elements and enforces restrictions.
- What you own & maintain: You own your lot and a pro-rata undivided interest in the shared irrigation system, which cannot be separated from the lot. The HOA maintains the irrigation system and interior roadways (not maintained by the county); you are personally liable for assessments even if you don't use water or roads.

Poultry/fowl: 12 per acre. Exotic family pets allowed (max 2 per residence, housed indoors). Small meat/fur animals: 12 per acre. All animals must be fenced or leashed; no barbed wire fences.
- Assessments & fees: The HOA can levy regular and special assessments for operation, maintenance, and reserves. Each lot owner pays an equal share based on lot ownership. Delinquent assessments incur 18% minimum interest and may result in a lien or suspension of water rights. The HOA may also charge for curing violations.
- Water & irrigation: Water from the Maricopa County Water Conservation District is delivered via a shared irrigation system. Each lot is entitled to a proportionate share based on acreage, but only if assessments and water charges are paid. Water may only be used to irrigate the lot; the HOA controls timing and quantity. Defaulting owners lose water rights.
- Signs & nuisances: Only one 'For Sale' sign (max 2 ft x 3 ft) is allowed. No noxious or offensive activities, dumping, or storage of non-operating vehicles. Weeds must be controlled; no outside toilets. All plumbing must connect to a septic or government-approved system.
