This is a full Declaration of Covenants, Conditions, and Restrictions (CC&Rs) for The Sanctuary at Sarival Village, a single-family home community in Scottsdale, AZ. The rules bind all homeowners, residents, and tenants. The HOA manages common areas, enforces architectural standards, and collects assessments.
- Architectural review: All exterior changes (construction, modifications, painting, landscaping) require prior written approval from the Design Review Committee (the Board). Approval criteria include aesthetics and harmony with the neighborhood. A review fee may be charged. No changes without approval, but interior work that does not affect the exterior is exempt.
- Residential use & home businesses: All lots must be used for residential purposes only. Home businesses are allowed if they are not visible or detectable from outside, do not generate customer traffic, and comply with other listed conditions. Leasing a residence is not considered a business.
- Leasing & rentals: Leases must be in writing, for an initial term of at least 6 months. No subleasing or assignments. Owners must provide tenant info to the HOA at least 10 days before lease start and provide copies of governing documents. Owners are liable for tenant violations.
- Pets: Only dogs, cats, and small household birds (reasonable number) are allowed as pets. The Board determines what is reasonable. Pets must be confined to the owner's lot; dogs must be leashed on common areas and owners must clean up feces. The Board may restrict areas where dogs are allowed and may require removal of dangerous or nuisance animals.
- Parking & vehicles: No commercial vehicles over 8 ft high or 24 ft long visible from neighboring property. No overnight contractor parking. Garage parking required if space available; otherwise driveway parking allowed. No storage of vehicles on lots except in garages (parking only). No inoperable vehicles visible. Streets may be used only if no space in garage or driveway.
- Assessments & fees: Regular assessments are levied equally per lot, set annually by the Board. Special assessments require 2/3 member vote and Declarant approval (while Declarant owns lots). Delinquent assessments create a lien on the lot and personal obligation. The HOA may suspend voting rights for nonpayment after 15 days' notice.
- Maintenance responsibilities: The HOA maintains common areas and certain improvements on lots as designated. Each owner is responsible for maintaining their own lot and structures, including keeping them in a neat condition. The Board may set a maintenance standard and assess costs for improper maintenance.
- Signs & antennas: No signs visible from neighboring property without Design Review Committee approval (except HOA or Declarant signs). Antennas and satellite dishes require approval unless prohibited by law; they must still comply with design guidelines.
