What Oasis at the Foothills's governing documents say
Oasis at the Foothills is a single-family home subdivision within the master-planned community The Foothills in Phoenix, AZ. This Tract Declaration adds supplemental rules and obligations to the master HOA's governing documents. Owners in the tract must comply with architectural review, a lake easement (if their lot is affected), a perimeter wall requirement, and an advertising fee due upon sale of a lot.
- Architectural review: No improvements may be made to any lot without prior written approval from the Design Review Committee (or Residential Design Review Committee once created). The Association's Board must also approve any subdivision plat or deed restrictions.
- Lake easement (lots 11-15): Lots 11-15 are subject to a 26-foot-wide easement for drainage, maintenance, and access to an adjacent lake. The Association may enter these lots upon 2 business days' notice (or immediately in an emergency) to maintain the lake, including temporary removal of structures, trimming vegetation, and storing equipment. Owners acknowledge potential noise and inconvenience; the Association is not liable for resulting nuisances, provided work is reasonable and debris is promptly removed.
- Wall construction obligation: The original buyer (developer) was required to construct a perimeter wall along the entire tract boundary within 12 months of recording. If not completed, the Declarant may finish it and charge the buyer, with an 18% annual interest on unpaid amounts. However, this obligation does not run with the land to an unaffiliated purchaser of a lot with a completed dwelling.
- Advertising fee on lot sales: The original buyer agreed to pay Declarant 0.5% of gross revenues from each lot sale to fund an advertising program. This fee runs with the land and is due upon each conveyance to a third party (except certain permitted transferees). Unpaid amounts accrue 18% annual interest and become a lien on the tract, subordinate only to purchase-money mortgages and tax liens.
