What Ironwood Clubhouse Site's governing documents say
This is an amendment to a tract declaration for the Ironwood Clubhouse Site, part of the Sun Lakes master-planned community. It governs the clubhouse property's relationship with the adjacent Ironwood Golf Course and the homeowners association. It does not contain the full rules for Sun Lakes homeowners.
- Golf cart access: The amendment grants an easement to the Ironwood Golf Course owner, tenants, guests, and users to access the golf course via golf carts over parking spaces on the clubhouse site, any adjacent association parking areas, and existing cart paths.
- Insurance requirements: The association must maintain general liability insurance of at least $1,000,000 combined single limit, naming the golf course owner as an additional insured. Likewise, the golf course owner must maintain similar insurance naming the association as an additional insured. Each party must receive certificates with 30-day cancellation notice.
- Parking lot maintenance cost sharing: The golf course owner reimburses the association 20% of the costs for parking lot maintenance, repair, and lighting that benefit both the clubhouse and the golf course. The association pays the remaining 80%. The association must provide a written reimbursement request, and the golf course owner may inspect records within 15 days. Payment due within 30 days of request (or 15 days after inspection if elected). Late payments accrue 10% annual interest.
- Dispute resolution: Any dispute between the association and the golf course owner relating to the declaration must be resolved by binding arbitration in Maricopa County under AAA rules, with a single arbitrator. The prevailing party recovers reasonable attorneys' fees and costs.
