This is a tract-specific declaration (Covenants, Conditions & Restrictions) for the East Golf Course (Phase I) within the larger master-planned community The Foothills in Phoenix, AZ. It applies only to the golf course land, not to individual home lots. It restricts the tract to golf course use for 15 years and requires prior design review approval for any improvements.
- Land use restriction: For 15 years from recording (April 1988), the tract may only be used as a golf course and related amenities (landscaping, paths, greens). Clubhouses, pro shops, restaurants, and separate commercial practice ranges are prohibited.
- Design & improvement approval: No improvements may be made without prior written approval from the Design Review Committee. The Association board must also approve any additional deed restrictions or documents recorded against the tract.
- Enforcement: Only the Maricopa County Assessor may enforce the use restriction. If violated, the Assessor may levy a tax penalty under Arizona law. Other owners in The Foothills have no right to enforce this restriction.
