What Palm Valley Community Center's governing documents say
This document governs the Palm Valley Community Center, a shared amenity within the larger Palm Valley master-planned community in Goodyear, AZ. It establishes a separate association to own, maintain, and operate the center, funded by mandatory assessments on all lots in the community. It is not a full set of HOA rules for individual homes—those are found in the Master Declaration and any tract declarations.
- Membership & voting: Every owner of a lot or condominium unit within the property is a member of the Community Center Association. Each lot gets one membership, and voting is by class: Class A (non-declarant owners) get one vote per membership; Class B (declarant) gets three votes per membership until conversion. Voting rights may be suspended for nonpayment or rule violations.
- Assessments & fees: All members must pay a one-time Reserve Contribution of $50 per membership at the later of recordation or closing. Annual Assessments start at a maximum of $240 per membership ($20/month), automatically increasing each year by the greater of 20% or the CPI increase, without member vote. Special assessments for capital improvements require a 2/3 vote of members. Reduced rates (25%) apply to undeveloped lots during construction.
- Use of the community center: All owners and their residents have a nonexclusive easement to use the community center, subject to association rules and potential admission fees. Use can be suspended for up to 60 days per infraction or indefinitely for delinquent assessments. The board may allow non-member use on a contract or fee basis.
- Enforcement & penalties: The association can impose fines, suspend voting and use rights, and record liens for unpaid assessments. It may also sue for enforcement and recover attorney's fees and collection costs. Delinquent assessments accrue interest at 18% per annum plus a late fee.
- Maintenance & insurance: The association maintains the community center and its improvements, using a high standard of care. It carries liability insurance of at least $2 million and may purchase other coverage. Owners are responsible for insuring their own personal property and liability not covered by the association.
- What this document doesn't cover: This document does not contain rules about individual home exteriors, parking, pets, landscaping, or leasing. Those restrictions, if any, would be in the Master Declaration for Palm Valley Phases II and III, any tract declarations, or separate CC&Rs for individual subdivisions.
