Palma Viva is a condominium community in Phoenix, AZ, comprised of townhouse units. This document is a First Amendment to the Declaration and Bylaws, focused on shifting roof maintenance responsibility from the association to individual unit owners, even though roofs are common elements. It applies to all unit owners.
- Roof maintenance & repair: Unit owners are responsible for maintaining, repairing, and replacing the roofs covering their townhouse units, even though roofs are common elements. For roofs shared between units (e.g., a common roof above two units or adjacent units without a partition), the shared owners must coordinate.
- Procedures for roof work: Owners must obtain at least three bids from qualified roofing contractors who have operated in Arizona for a minimum of five years, are licensed and bonded, and provide a guarantee of at least 2 years on workmanship and 20 years on materials. The Board of Directors must approve the contractor's written quotation in writing, with a minimum 24-hour review period. Repairs cannot include additions or structural changes to the existing roof design.
- Dispute resolution for shared roofs: If adjoining owners cannot agree on shared roof repair or replacement, either owner may request the Board of Directors to make a binding decision. If a roof is damaged by the act of an adjoining owner or their guests/tenants, that owner must restore the roof at no cost to the other owner(s), who may enforce this via legal action.
- Association intervention & special assessments: If owners of adjoining units do not resolve roof repairs within 21 days after written notice from the Board, the association may directly contract for repairs and levy a special assessment against the involved owners to recover the costs.
- Structural changes: Except for roof repairs as provided, no owner may make structural alterations, improvements, or additions to their townhouse unit without the association's written consent. No owner may impair the structural soundness or integrity of the buildings, or paint or decorate any exterior portion without consent.
- What this document doesn't cover: This is a partial amendment. It does not cover rules for pets, leasing, age restrictions, parking, utilities, insurance, or other common covenants. Those would be in the full Declaration and Bylaws.
