What Palms Resort Retirement Community's governing documents say
This is a pre-development Declaration of Covenants, Conditions and Restrictions for Palms Resort Retirement Community, a two-lot commercial property in Phoenix. It governs the construction and shared maintenance of an underground tunnel and temporary access ramp between the two lots. This document binds only the owners of Lot 1 and Lot 2 and does not establish rules for residents, homeowners, or typical community living.
- Plan of development: The property consists of two lots (Lot 1 and Lot 2) subject to this declaration. The lots are to be developed with parking structures and connected by underground tunnels (Lot 1 Tunnel and Lot 2 Tunnel) and a temporary access ramp.
- Easements & tunnels: Lot 1 grants Lot 2 an easement to construct the Lot 2 Tunnel under a portion of Lot 1. Lot 2 grants Lot 1 an easement to construct the Lot 1 Tunnel. Lot 1 also grants a temporary access ramp easement to Lot 2 until Lot 1's parking structure and its tunnel are complete.
- Cost sharing: Costs for plans, construction of the Lot 2 Tunnel and temporary access ramp are shared equally between both lot owners. Similarly, costs for the Lot 1 Tunnel and demolition of the temporary ramp are shared equally. Each owner invoices the other, with payment due within 10 days.
- Maintenance responsibilities: Lot 2 is responsible for maintaining the Lot 2 parking structure, both tunnels, and the temporary ramp. Costs for the Lot 1 Tunnel maintenance are shared equally. Lot 1 is solely responsible for its own parking structure.
- Use restrictions: No rubbish, odors, loud noises, nuisances, or infectious conditions. Buildings must be kept in good repair. No mineral exploration. Utility lines must be underground except temporary construction or screened satellite dishes.
- Amendment & termination: The declaration can be amended by Declarant while it owns all lots, or by all lot owners thereafter. It can be terminated by recording a certificate of termination signed by Declarant or all lot owners.
- What this document doesn't cover: This document does not include any residential rules (e.g., age restrictions, pet limits, leasing terms, assessments, or architectural controls for individual homes). It is limited to pre-development infrastructure between two commercial lots.
