What 4141 N. 32nd Street, a Condominium's governing documents say
This is a condominium community in Phoenix, AZ, designated exclusively for commercial and medical professional offices — no residential use is allowed. You own your individual unit and an undivided interest in the common elements, which the association maintains and insures. The association levies annual and special assessments to cover common expenses.
- Use restrictions: Units may only be used for professional offices, including physical therapy and outpatient medical services. No residential use is permitted. The Declarant (developer) has the right to approve other uses, and a specific unit (Unit 100) is reserved for endodontic dentistry for as long as a named tenant occupies it.
- Leasing & rentals: Unit owners may lease their units, but any lease must be in writing and must state that it is subject to the Declaration, Articles, and Bylaws. The owner must notify the association of the tenant's name and contact information. Leasing less than an entire unit requires the Declarant's consent.
- Pets & animals: No animals, birds, reptiles, or insects may be raised, bred, or kept in any unit or on the property, except fish in aquariums (subject to association rules). Service animals are allowed as provided by law.
- Assessments & fees: Each owner must pay annual assessments (monthly or as set by the board) and special assessments (approved by 2/3 of votes) for common expenses including maintenance, insurance, utilities, and reserves. Unpaid assessments bear interest at 20% per year and become a lien on the unit; voting rights are suspended after 60 days delinquency.
- Architectural review: Exterior modifications, including window treatments visible from outside and any changes affecting the structure or common elements, require prior written approval from the Architectural Control Committee or the Board.
- Parking & vehicles: The association allocates parking spaces, which may be assigned as limited common elements. Boats, campers, trailers, commercial vehicles (except standard pickup trucks or vans), and inoperable vehicles are prohibited from parking on common areas. No vehicle repairs are allowed on common areas.
