Paradise Drive Estates Amended is a single-family home community in Scottsdale, AZ, governed by a homeowners association (HOA). These CC&Rs set strict architectural and use standards to maintain a luxury custom-home character. The HOA enforces rules, maintains common facilities, and can levy assessments on each lot.
- Architectural control & design standards: All exterior improvements must be approved by the Architectural Committee. Permitted architectural styles are Southwestern, Territorial, or Mediterranean (not Tudor, Colonial, or Modern). Minimum net livable area for a residence is 3,250 square feet. Roofs must be clay tile or concealed built-up; shake, corrugated metal, concrete tile, and composition roofs are prohibited. Wood, plastic, aluminum, or asbestos siding/shingles are prohibited. Garages must be side-entry, hold at least two cars, and carports are not allowed.
- Height & lot coverage limits: Lots 1–4: height limited to Scottsdale zoning. Lots 5, 6, 9, 10: single-story with max roof height 24 feet above finished floor. Lots 7, 8: single-story but no specific height limit stated; however, they are subject to the 'Single Story' definition which limits a loft or second living area to no more than 20% of the livable area.
- Landscaping & lot maintenance: Front yards must be landscaped per Architectural Committee approval, with minimum 50% Bermuda grass. Yards visible from neighboring property must have at least 50% green groundcover from an approved plant list. Landscaping must be completed within three months of finishing construction; dead plants must be replaced within 30 days. Owners of undeveloped lots must keep them graded, clean, and free of weeds/debris, or the HOA may step in at the owner's expense.
- Vehicles, recreation, & animals: No boats, trailers, motor homes, or other recreational vehicles may be stored on any lot unless in an enclosed shelter not visible from any street or neighboring property. No direct vehicular access from lots onto 104th Street or Cactus Road. Horses and structures for stabling farm animals are prohibited.
- Fences & walls: Each owner must erect a masonry fence straddling boundary lines adjoining another lot. The adjoining owner (except Declarant) must pay 50% of the cost upon accepting their deed. Maintenance of perimeter walls' interior face is the abutting owner's responsibility.
- HOA structure & assessments: A homeowners association will be formed after all lots are sold or earlier at Declarant's choice. Each lot has one vote. The annual assessment is initially capped at $420 per lot for the first year; thereafter the amount is set by majority vote at annual meetings. Special assessments require a 2/3 vote of members present at a meeting. Assessments are a lien on the lot, and the HOA can enforce collection, including foreclosure.
- Fines & enforcement: The Board may impose reasonable fines for violations of the CC&Rs by owners, family, tenants, or guests. Fines are secured by the assessment lien. The prevailing party in enforcement actions recovers reasonable attorneys' fees and costs.
