This is a standard single-family homeowners association (HOA) for Montagna Vistas, a luxury custom-home subdivision in Scottsdale, AZ. It establishes strict architectural controls, minimum home size, and landscaping standards to maintain a high-end residential character. The HOA is run by a board of directors, with mandatory assessments and liens for nonpayment.
- Architectural review: All exterior improvements (new construction, alterations, landscaping) must be approved by an Architectural Committee. Approved architectural styles are Southwestern, Territorial, or Mediterranean only; Tudor, Colonial, and Modern are prohibited. Plans are deemed approved if not acted on within 30 days.
- Minimum home size & design: Homes must have at least 3,500 square feet of net livable area. Residences on Lots 3 and 4 are limited to single-story with a loft (max 20% of livable area) and roof height max 30 feet. Garages must be side-entry and hold at least two full-size American cars; carports are prohibited.
- Roofs & siding: Prohibited roofs: shake, corrugated plastic/sheet metal, high-gloss concrete tiles, and composition. Permitted roofs: clay tile, no-gloss true color tile, concealed built-up roofs. Prohibited siding: wood, plastic, aluminum, asbestos. Spanish Lace stucco finishes banned.
- Landscaping & yards: Front yards must be landscaped per a written plan approved by the Architectural Committee, with a minimum $5,000 expenditure. At least 50% of front yard must be green grass. Yards visible from neighboring property must have 50% green groundcover. Landscaping must be completed within 3 months of home completion; dead plants must be replaced within 30 days.
- Vehicles & parking: Boats, trailers, motor homes, and other recreational vehicles may only be stored in an enclosed shelter not visible from any street or neighboring property. Construction vehicles must park only within the building envelope.
- Assessments & liens: Annual and special assessments are levied uniformly per lot. Nonpayment creates a lien on the lot, which can be foreclosed. The lien is subordinate to first mortgages. Delinquent assessments accrue interest and late fees set by the board.
- Enforcement & fines: The board may levy fines for violations of the declaration, and these fines are secured by the assessment lien. The prevailing party in enforcement actions recovers reasonable attorneys' fees.
