You own your individual unit as a freehold estate, plus an undivided interest in the limited and general common elements, with the association responsible for maintaining the common areas, exteriors, and roofs, while you maintain the interior.
- What you own & maintain: Each unit is a separately owned space bounded by interior surfaces of perimeter walls, floors, ceilings, windows, and doors. The owner maintains the interior and all fixtures within the unit. The association maintains all common elements, including exteriors, roofs, landscaping, streets, parking areas, and recreational facilities.
- Assessments & fees: Each unit pays an annual assessment (initially up to $480 per year) plus special assessments for capital improvements or deficits, shared 1/72 for general common elements and 1/4 per building for limited common elements. Unpaid assessments become a lien on the unit, with 8% annual interest, and the association can foreclose.
- Architectural review: No exterior improvements (buildings, fences, walls) may be made without prior written approval from the homeowners corporation. Plans must be submitted; if not approved or disapproved within 30 days, approval is deemed granted. Changes that increase square footage are prohibited.
- Use restrictions: Units are limited to single-family townhouse use, no more than two stories. Temporary structures, trailers, tents, or outbuildings are not allowed as residences. The builder may maintain a temporary sales office during construction.
- Party walls: Walls between units are party walls. If damaged by an owner's act, that owner must rebuild at own cost. If damaged by other causes, all four adjoining owners share repair costs equally. Modifications require written consent of the other three owners.
- Insurance: The board must obtain master fire and liability insurance on all buildings and common elements, payable to the board as trustee for unit owners. Unit owners are individually responsible for insuring personal property and may be billed for premiums if the board obtains coverage on their unit.
