What Rancho Santa Fe Del Oro II's governing documents say
Rancho Santa Fe Del Oro II is a single-family residential community in Phoenix, AZ where you own your individual lot and residence. The community is governed by a homeowners association that maintains common areas, streets, and landscape easements, funded by annual assessments. The declaration enforces strict architectural and design standards through an Architectural Committee that must approve all exterior improvements.
- What you own & maintain: You own your lot and the residence and outbuildings on it. The association maintains all common areas, streets within the subdivision (not yet accepted by the city), landscape easement areas along Jimson Loco Lane and Santa Fe Trail, and carries fire/casualty insurance and $1 million public liability insurance.
- Residences & construction: New residences must contain a minimum of 3,000 square feet of livable area and be set back 40 feet from the front, 20 feet (or 10% of lot width, whichever is larger) from the sides, and 35 feet from the rear. All construction must be completed within 18 months of the start date. The residence must be new material; no buildings may be moved from other locations onto the lot, and no prefabricated structures are permitted.
- Architectural review process: The Architectural Committee must approve in writing all residences, improvements, alterations, repairs, and exterior changes before work begins, considering suitability, materials, harmony with surroundings, and aesthetic factors. The Committee's decision is final with no right of recourse. Approval of one plan does not waive the right to disapprove similar plans later.
- Landscaping requirements: Front-yard landscaping must be approved by the Committee and include a minimum of 10 trees of 15 gallons or larger, installed within 60 days of occupancy. Owners are responsible for maintaining all landscaping visible from other lots or streets in neat condition. If an owner fails to maintain after 30 days' written notice, the association may perform the work and levy the cost as an Extraordinary Assessment.
- Vehicles, storage & repairs: No vehicle maintenance, repair, or construction (except emergency repairs) is allowed without prior written approval from the association. Automobiles and station wagons are exempt from this rule. Pickup trucks of 3/4 ton or smaller used for personal/pleasure purposes are permitted if they have no camper shells. No vehicles may be parked on streets except briefly for loading/unloading, and no abandoned or inoperable vehicles may be visible from other lots.
- Prohibited structures & uses: Trailers, motor homes, buses, trucks larger than 3/4 ton, motorcycles, mini-bikes, RVs, mobile homes, and permanent tents are not permitted anywhere in the subdivision. No chain-link fences, boundary fences, or commercial uses are allowed. No visible TV/radio antennas are permitted; ham radio towers must be manually or electrically lowered when not in use and remain invisible from neighboring properties.
- Pets & animals: A reasonable number of house pets—such as dogs, cats, and rabbits—may be kept as pets, provided they are not bred or maintained for commercial purposes (except puppies and kittens until weaned). Livestock, fowl, pigeons, and other animals are prohibited. Any structures for pet care must be screened to be invisible from neighboring properties. Noisy pets such as barking dogs that are bothersome to the majority of neighboring owners must be removed.
- Assessments & fees: The initial annual assessment is $1,500 per lot. Annual assessments may increase up to 10% per year; increases above 10% require a two-thirds vote of all members. The association may also levy Extraordinary Assessments for owner misconduct or failure to maintain a lot, and Special Assessments (with two-thirds vote) for major common area improvements. Delinquent assessments accrue a $25/month late charge plus 18% annual interest, and the association may foreclose the assessment lien like a mortgage.
