Sands Royal Palm Square is a townhouse community in Phoenix, AZ where you own your individual unit and lot while sharing ownership of common elements maintained by the HOA. Owners are responsible for unit interiors and yards; the Association maintains building exteriors, roofs, common streets, parking, and landscaping through per-lot assessments and special fees.
- What you own & maintain: You own your townhouse interior, doors, windows, yard, and landscaping. The Association maintains all exterior building surfaces, roofs, gutters, common streets, alleys, parking areas, and shared landscaping. If you cause damage through negligence, you pay for repairs.
- Assessments & fees: Annual assessments are set by the Board and divided equally among all lots. The maximum first-year assessment is $360 per lot; after that, increases are tied to the Consumer Price Index and require a 2/3 member vote. Special assessments for capital improvements also require 2/3 approval. Late payments incur 10% annual interest and create a lien on your property.
- Architectural approval: Any new construction, fence, or exterior improvement requires Board approval of plans and specifications before work begins. The initial approver is American Builders, Inc. Household pets are permitted, but not hogs, goats, horses, poultry, rabbits, sheep, or pigeons. No trucks, buses, trailers, boats, or campers without Board approval. You cannot rent part of your unit; if renting, the entire lot must be rented as one dwelling.
- Voting & governance: You have one vote per lot as an owner. While the builder is constructing the project, the builder holds three votes per lot; this switches to one vote after 2 years or when owner votes exceed builder votes. Voting rights are suspended if you fall 15+ days behind on assessments.
- Damage liability & repairs: If you or your guests damage common elements or another unit, you must repair it within 30 days or the Association can do the work and bill you. Unpaid repair charges become a lien on your property and accrue 10% annual interest.
- Insurance: The Association buys fire, casualty, and liability insurance on all buildings and common areas, funded through assessments. You must carry your own homeowners and liability insurance. If insurance proceeds don't cover all repair costs from a casualty, the Board can levy a special assessment to cover the gap.
