Silverhawke is a master-planned single-family residential community in Phoenix, Arizona (Maricopa County), developed by Centex Real Estate Corporation. You own your individual lot and home; the association maintains common areas, funded by per-lot assessments. The community has extensive use restrictions, mandatory architectural review for all exterior changes, and detailed maintenance requirements.
- What you own & maintain: You own your lot and all improvements on it. The association maintains common areas, including perimeter walls and drainageways. You own the half of party walls closest to your lot's center; the association owns the outer half of perimeter walls.
- HOA assessments: Initial maximum: $25/month per lot. After the first year, annual assessments can increase up to 5% without a vote; increases above 5% require a 2/3 member vote. Special assessments for capital improvements also require a 2/3 vote. Non-payment creates a lien on your property and accrues interest at the VA mortgage rate.
- Maintenance obligations: You must maintain your lot in 'clean and attractive condition'—free of rubbish and weeds, with healthy landscaping and well-maintained structures. The association can enter your lot to make repairs if you don't comply within 5 days of written notice, and you'll pay the cost. No interior maintenance is required by the association.
- Architectural review & alterations: All exterior improvements, alterations, and additions—including painting and solar panels—require written approval from the Architectural Review Committee before you start work. You must submit plans, specifications, plot plans, and grading plans showing appearance, height, materials, and color.
- Residential use only & home offices: The community is restricted to single-family residences; no business activities are allowed. Home offices are permitted with Board approval, but only if operated by household members, occupying no more than 25% of usable interior space, with no employees, no exterior signs, and limited to 7 a.m.–9 p.m. hours.
- Yard setbacks & height limits: Lots with reverse frontage on Neely Street, Guadalupe Road, or Houston Street must have a minimum 110-foot depth and 15-foot rear setback. Lots 248–253 and 188–194 are limited to one-story structures not exceeding 25 feet in height.
- Voting rights & governance: Each lot owner has one vote (Class A). The developer (Declarant) initially has three votes per lot (Class B), converting to Class A membership when Class A votes exceed Class B votes or after 10 years, whichever is earlier. Voting rights are suspended if your assessments are unpaid or for up to 60 days for rule violations.
- Insurance: The association obtains and pays for master insurance covering common-area improvements and public liability. You are responsible for homeowner's liability insurance and theft/property insurance on your own improvements. You are liable to the association for any damage to common areas caused by you or your guests.
