What Stapley Estates's governing documents say
Stapley Place is a residential planned unit development (PUD) in Phoenix, AZ. This document is the Declaration of Covenants, Conditions, and Restrictions that creates the homeowners association, defines lot ownership and common area, and sets rules for all owners, occupants, and their invitees. It covers what you own, what the association maintains, assessments, architectural controls, and use restrictions.
- What you own & maintain: You own your lot and the building on it, and you are responsible for all interior and exterior maintenance, repairs, and replacements (roofs, windows, doors, utilities within the lot, etc.). The association maintains the common areas and landscaping on lots readily accessible to crews.
- Assessments & fees: All owners pay regular assessments to cover common expenses. The initial maximum annual assessment is $900 per lot. The board can increase it each year by up to 5% or based on CPI, whichever is greater, without owner vote; larger increases require a 2/3 vote of each membership class.
- Architectural review: No exterior structures, additions, or alterations (fences, awnings, antennas, etc.) may be made without prior written board approval. Plans must be submitted showing design, materials, and location.
- Leasing & rentals: Leasing is addressed (Section 8.14), but the specific text is garbled. Expect that leases must comply with board rules; prospective renters should confirm leasing minimum term and restrictions with the association.
- Parking & vehicles: Each lot has an assigned garage/parking space per the plat. No commercial vehicles, buses, boats, or trailers may be parked long-term without board approval. Temporary parking for guests and deliveries is allowed.
- Signs & external fixtures: No signs visible from public view without board approval except one reasonable 'for sale/rent' sign on the lot. External fixtures like antennas, satellite dishes, clotheslines, and window covers are restricted; standard curtains and drapes are allowed.
- Use restrictions & nuisance: All lots are for residential use only; no business or commercial activity without board approval. Noxious activities, nuisances, and anything that increases insurance rates are prohibited. Temporary structures and outside laundering are generally banned.
- Pets: Pets are covered (Section 8.13), but the text is truncated. Likely pets require board approval and limits on number/size; confirm current association rules.
