What Stapley Terrace's governing documents say
This is an amendment to the original Covenants, Conditions and Restrictions (CC&Rs) for Stapley Terrace, a small community of 4 lots in Phoenix, AZ. The amendment adds a new rule requiring the homeowners' association to charge each lot owner a pro rata share of the monthly sewer, water, and trash bills. This document is a partial update to the full CC&Rs and does not contain the complete set of community rules.
- Utility assessments: The homeowners' association must split the monthly sewer, water, and trash bills equally among the 4 lots (identified by APNs 138-14-069 through 138-14-072). The association then bills each owner their share, which must be paid within 15 days of receiving the invoice.
- Lien for nonpayment: If an owner fails to pay the assessed utility share on time, the amount becomes a lien on their lot, and the association can pursue the same collection remedies as for regular assessments under the original CC&Rs.
- What this document doesn't cover: This amendment only addresses utility cost allocation. It does not contain any other rules about pets, leasing, parking, architectural changes, or community amenities. The full CC&Rs from 1983 govern those subjects.
