What The Highlands at Mountain Park Ranch's governing documents say
The Highlands at Mountain Park Ranch is a Phoenix subdivision where individual homeowners own single-family lots subject to building and architectural restrictions. These documents—primarily a 1988–1990 Declaration of Property and Building Restrictions—govern what you can build on your lot, where, and how it must look, but do NOT establish an HOA, assessments, or rules for shared common areas. They are supplementary to a master declaration filed in 1984.
- Building height & elevation: No structure may exceed one story above ground or an elevation of 1,335 feet above Mean Sea Level. Specific lots have additional floor-elevation caps (e.g., Lot 204 capped at 1,320 feet finished floor, 1,322 feet rear patio).
- Setbacks & lot placement: Front yards must set back a maximum of 25 feet from the lot line. Rear yards must set back a minimum of 30 feet. A solid 3-foot wall must be erected at the rear setback line.
- Architectural standards: Buildings must feature a flat or pitched roof designed to be invisible from the rear patios of neighboring lots. All exterior colors must be brown or tan earthtone acceptable to the development.
- Landscaping: Landscaping in the rear setback area must match the natural landscape of Mountain Park Ranch and be sufficiently dense to conceal all improvements when viewed from neighboring lots.
- Outdoor lighting: No light source on your lot may be visible from neighboring lots. All outdoor lights must be downward-directed and not exceed 30 inches in height (except where required by Phoenix building codes).
- Private access way maintenance (Lots 296 & 297 only): Lot 297 owners must reimburse Lot 296 owners for one-half the cost of maintaining the private access way within 10 days of invoice, or pay 18% annual interest on overdue amounts.
- Duration & termination: These restrictions run until May 24, 2004, then automatically extend for successive 10-year periods unless a majority vote of affected lot owners terminates them within six months before expiration. Unanimous consent can terminate early.
- What this document doesn't cover: This is a building/architectural restriction document, not a full HOA rulebook. It does not address HOA governance, assessments, board procedures, common areas, amendment processes, enforcement by an association, leasing rules, pets, parking, or the broader homeowner community rules—those are governed by the master 1984 declaration and any current HOA documents.
