What The Papago's governing documents say
This is a Declaration of Covenants, Conditions and Restrictions (CC&Rs) for a commercial/industrial planned development in Phoenix, AZ, originally recorded in 1990. It governs the use, development, and maintenance of parcels intended for office, commercial, retail, and light industrial uses, not for standard residential living. The rules apply to parcel owners, lessees, and occupants, with an Operating Committee overseeing compliance and design review.
- Use restrictions: Parcels cannot be used for mobile home parks, junkyards, gasoline dispensing, auto repair, self-service laundry, retail over 5,000 sq ft (except restaurants/financial services), or any use deemed incompatible. All operations must be within enclosed buildings, and no nuisance activities (vibration, noise, pollution) are allowed. Animals are prohibited except small domestic pets in authorized residential development.
- Building & design standards: All improvements require prior plan approval by the Operating Committee, with detailed submissions required (site, floor, elevation, civil, landscape plans). Buildings must be masonry or concrete. Roof mechanical equipment must be screened. Signs require approval. Plan review fee is up to $500 per submission, with additional resubmission fees up to $300.
- Maintenance obligations: Each owner maintains their parcel's improvements in good condition, including painting, paving, and landscaping. The Operating Committee maintains common landscape borders (up to 20 ft width) and property identification signs, with costs shared among parcel owners based on parcel acreage.
- Operating Committee: Initially controlled by the developer, the Committee transitions to owner-elected representatives (3 members, 1-year terms) once the developer no longer holds an interest. Voting is by acreage. The Committee approves plans, enforces rules, and may impose liens.
- Enforcement & liens: Violations allow the Operating Committee to enter the parcel, abate issues at owner expense, and file a lien for unpaid costs. Interest accrues at 18% per annum. The prevailing party in enforcement proceedings recovers attorneys' fees.
- Duration & amendment: Restrictions run until December 31, 2020, with automatic 10-year renewals. Termination or amendment requires a written declaration signed by owners of at least 75% of total acreage. The developer must join amendments while it owns any interest.
