Pete and Mac’s Condominium Project is a commercial condominium in Phoenix, AZ — units may be used as offices (including veterinary, medical, dental, or professional) or retail (including animal boarding, day-care, and grooming), but not for restaurants, dialysis clinics, outpatient surgery (except minor procedures), or addiction treatment. The declaration binds unit owners, who own their unit's interior and share common elements maintained by the association.
- Permitted uses: Units may be used for offices or retail. Prohibited uses include restaurants, massage services (except by licensed physician or physical therapist), dialysis clinics, outpatient surgery involving general anesthesia, and rehabilitation for chemical dependencies. No residential use is allowed.
- Parking & vehicles: No trucks, trailers, campers, boats, recreational vehicles, or commercial vehicles may be parked or stored. No inoperable vehicles allowed. Parking is only in designated areas; visitor parking is for visitors only. The association may tow violators at owner's expense.
- Signs: Exterior signs are limited to building-mounted signs in designated locations and monument sign panels assigned to units. For-sale and for-lease signs are permitted. All signs must conform to association rules and the approved sign plan.
- Alterations & improvements: Non-structural interior alterations do not require approval. Structural changes require prior written approval from the board, with plans and a structural engineer's certification. No alterations to common elements without board approval.
- Maintenance responsibilities: The association maintains all common elements, including covered parking spaces. Unit owners maintain their own units and limited common elements (e.g., building-mounted signs, monument sign panels, and the outdoor play area for Unit 1). Owner-paid janitorial service is required.
- Assessments: Common expense assessments are based on each unit's percentage interest (Unit 1: 52.9%, Unit 2: 13.4%, Unit 3: 33.7%). The board sets the budget and may increase assessments mid-year. Special assessments may be levied for capital improvements. Delinquent assessments bear interest and are secured by a lien.
- Insurance: The association carries property insurance on common elements and units (exclusive of owner improvements) and liability insurance (minimum $1M per occurrence).
