What The Preserve at Cave Creek's governing documents say
The Preserve at Cave Creek is a condominium community in Phoenix, AZ — you own your individual unit and a share of the common elements (like the building structure, grounds, and access gate), while the association maintains the common areas and carries master insurance. Unit owners are responsible for maintaining their unit's interior and certain limited common elements (such as the deck and patio). This Declaration governs all use, restrictions, and obligations of owners, tenants, and guests.
- Leasing & rentals: Leases must be in writing, for the entire unit, with a minimum term of 30 days. No subleasing or assignment. Owners must provide the association with a copy of the lease and contact info at least 10 days before move-in. Owners are liable for violations by tenants.
- Pets: No more than two domestic pets (dog, cat, fish, or bird commonly kept as household pets) per unit. Dogs must be leashed when outside the unit, and owners must immediately clean up feces. The board may adopt additional rules, including weight/height limits if approved by a majority vote.
- Residential use & home businesses: All units must be used exclusively as residences. Home businesses are allowed only if not visible or detectable from outside, conform to zoning, involve no client visits, and are consistent with residential character. Leasing a unit is not considered a business.
- Alterations & improvements: Nonstructural interior changes do not require board approval, but structural changes or any alteration visible from the exterior must be approved in writing. The board may require plans, insurance, and a security deposit. Owners are responsible for any damage caused by alterations.
- Parking & vehicles: Vehicles may only be parked in designated parking spaces. No inoperable vehicles, and no repairs (except emergency) on the property. The association may tow violating vehicles at the owner's expense.
- Common elements & limited common elements: The association maintains all common elements (e.g., building exterior, landscaping, access gate). Limited common elements — like decks, patios, exterior windows and doors — are assigned to specific units; owners must maintain the interior surfaces of those areas. Decks cannot have jacuzzis or barbecues; patios may, subject to rules.
