What The Residences on High Street Condominium's governing documents say
The Residences on High Street is a condominium in Phoenix, Arizona — you own your unit through a sublease (not outright purchase) in a mixed-use building with retail on the ground floor and residential units on the upper three floors. The association maintains the shared structure and systems, funded by per-unit assessments; a separate parking agreement provides limited parking rights.
- What you own & maintain: You own your unit via sublease from the declarant; the association maintains all common elements (building structure, utilities, elevators, landscaping). You are responsible for maintaining your unit interior.
- Parking & vehicles: Parking is not part of the condominium. Unit owners and occupants have parking rights to a portion of the 2nd level of a separate six-story parking garage under a separate Parking Agreement.
- Assessments & fees: Assessments are levied per unit to cover common expenses including maintenance, management, utilities, trash, insurance, and reserves. Special Assessments and Enforcement Assessments may also be levied; failure to pay assessments results in an Association lien on your unit.
- Insurance: The association maintains fire, casualty, liability, worker's compensation, and other insurance on the common elements and building, with costs included in assessments.
- Residential use & restrictions: Units are restricted to residential use only. Unit owners must comply with association rules on alterations, window coverings, terraces, nuisances, and offensive activities. Specific restrictions are detailed in the association rules, which are garbled or incomplete in this document excerpt.
- Building structure & future expansion: The condominium initially consists of the upper three floors of the building at 5315 East High Street. The adjacent building at 5355 East High Street is currently used as apartments but may be annexed into the condominium in the future at the declarant's discretion.
- Ground lease & sublease arrangements: Your sublease interest is subject to both a Ground Lease from Arizona State Land Department and an Air Rights Sublease. These affect your long-term rights to the property and must be complied with by all unit owners.
- What this document doesn't cover clearly: This is the founding condominium declaration; specific lease term restrictions, pet policies, and detailed use rules are referenced but either garbled in this OCR or contained in separate association bylaws and rules documents not included here.
