This is a specialized agreement between the Desert Ridge Community Association and Phoenix Resort, LLC (the resort owner, likely Marriott) that governs the resort parcels and golf courses within the Desert Ridge master-planned community. It is not a full set of homeowner rules — it outlines design review, maintenance responsibilities, and use restrictions for the resort land, and it binds the resort owner, not individual homeowners. Homeowners in Desert Ridge are primarily governed by the community’s main CC&Rs.
- Design review & construction approvals: The resort owner must complete design review under the community's Design Guidelines before starting construction. The association has approved the site plan for the resort and golf course parcels, subject to changes noted on Exhibit D.
- Maintenance of resort common areas & wash corridors: The association delegates to the resort owner the responsibility for maintaining the Resort Common Areas (landscape and hardscape along Pathfinder Drive and 51st Street) and all wash corridors within the parcels. If the resort owner fails to maintain them for 30 days after notice, the association may step in and charge the costs as a maintenance assessment against the resort property.
