This is an ancillary covenant that applies only to Villa 27 at The Rocks Club Condominium in Phoenix, AZ. It allows the villa to be used as part of an equity vacation club program, with restrictions on renting and public advertising. The document binds the current and future owners of this specific unit, and is not the main condominium rules for the entire community.
- Use & rental restrictions: The villa cannot be rented or leased to the public, nor can it be publicly advertised. Use is limited to an equity vacation club's members and their guests, following the club's reservation policies.
- Furnishings & maintenance: All standard furnishings are owned and maintained by the condominium association. If the owner adds custom furnishings, they are responsible for maintaining, repairing, and insuring those items.
- Assessments & fees: The owner pays the regular common expense assessment plus a special assessment to cover operating costs equivalent to resort villas. Reserve expenses are handled separately for this villa.
- Transfer & termination options: When selling, the owner may either (a) transfer the villa subject to this covenant, (b) terminate the covenant by purchasing the furnishings and selling as a normal whole villa, or (c) convert the villa to a club villa under the main declaration.
- Voting rights: The owner is a member of the condominium association and votes according to the allocated votes for villas, but does not have voting rights on matters reserved for resort villa owners.
- What this document doesn't cover: This document does not contain the full condominium rules for all units. It only applies to Villa 27. For community-wide regulations, refer to the main Declaration of Covenants, Conditions and Restrictions for The Rocks Club Condominium.
