The Terraces at Tiburon is a 31-unit condominium community in Phoenix, AZ. You own your unit (including interior and fenced rear yard) plus an undivided 1/32 interest in the common areas, which include the land, buildings, recreational facilities, and parking. The association maintains common elements and exteriors; you maintain your unit's interior, appliances, and limited common elements like patios. This full rulebook governs use and occupancy for all owners, tenants, and guests.
- Single-family residential use: Units and limited common elements may only be used as a residence by a single family (group related by blood/marriage/adoption, or a group not all related maintaining a common household). No business, trade, or profession is allowed, though personal professional library or business calls are permitted.
- Pets: Only a reasonable number of house pets allowed, kept solely as domestic pets. Dogs must be leashed (max 6 ft) when outside the unit or limited common elements, and owners must immediately remove droppings. No structures visible from outside for animal care. Board can determine reasonableness.
- Vehicles & parking: All vehicles belonging to owners must be parked inside the garage at all times. No mobile homes, RVs, boats, trailers, trucks, campers, or inoperable/abandoned vehicles may be kept on the property. Vehicle repair or construction on the condominium is prohibited.
- Signs & exterior appearance: Only a name/address sign up to 9x30 inches is allowed on the exterior without approval. No reflective materials (foil, reflective screens) on windows without Architectural Committee approval. Outside clotheslines, antennas, and window coverings affecting exterior must also get prior written approval.
- Architectural alterations: Structural alterations to a unit or common elements require approval by 80% of members. Nonstructural interior changes are allowed without approval, but any alteration visible from the exterior needs Architectural Committee approval (must be aesthetically pleasing). All additions must not impair structural integrity.
- Assessments & fees: Each owner must pay annual assessments, plus special assessments for capital improvements and supplemental assessments. Unpaid assessments become a lien on the unit and a personal obligation. Late payment may result in suspension of voting rights after 15 days delinquency.
- Maintenance responsibilities: The association maintains all general common elements (roofs, exterior walls, landscaping, parking areas, etc.) at common expense. Each owner maintains their unit's interior, doors, windows, HVAC, plumbing, and appliances. Owners also maintain limited common elements (patios, stoops) except structural parts. Party fences between units are maintained jointly.
