What The Twelfth Street Registry's governing documents say
This is a partial document — a 2000 amendment to the HOA covenants for The Twelfth Street Registry, a townhome-style community on lots with party walls and common area in Phoenix. It amends specific rules but omits many basics (leasing, pets, rentals, age rules) that may be in the full declaration.
- Maintenance of Lawns & Plantings: Owners must maintain all lawns and plantings in their rear yard and front yard (the portion between the entry gate and main entry door). The Association handles common area landscaping. Removing or altering any trees/shrubs on common area requires written consent from the Board or Architectural Committee.
- Party Walls & Fences: The Association may, with approval of two-thirds (2/3) of each class of members, decide to take over the painting of exterior walls, fences, doors, windows, and trim of all buildings on owners' lots. Individual owners may not paint their own exterior without prior Architectural Committee approval.
- Utility Easements: A blanket easement exists over the Common Area for installing, repairing, and maintaining all utility lines (water, sewer, gas, electric, phone, cable, etc.). New utility installations beyond the initial plan must be approved by 51% of each class of members. Utilities may not be placed under permanent buildings.
- Assessments & Voting: Annual assessments may increase up to 5% above the previous year without a membership vote. Special assessments for capital improvements require 51% approval of each class of members, and may be payable over up to seven years. Written notice for any such vote must be sent 15–60 days in advance; a quorum is 51% of each class.
- Owner Maintenance Responsibilities: Each owner is responsible for upkeep of the interior of their dwelling unit and any part of the lot not maintained by the Association, including painting the exterior only in colors approved by the Architectural Committee. Owners must also handle termite control and must not do anything that impairs structural soundness or damages other units.
- What this document doesn't cover: This amendment does not address leasing restrictions, pet limits, age restrictions, parking, or rental caps. Those rules, if any, would be in the full recorded Declaration (the original covenants).
