What Greenway Hills's governing documents say
Greenway Hills is a standard single-family home HOA in Phoenix, AZ. This document is an amendment to the recorded Declaration of Covenants, Conditions, and Restrictions (CC&Rs), changing specific rules about voting, assessments, home businesses, vehicle parking, trash containers, and landscaping. It binds all lot owners in the subdivision.
- Voting rights: Each lot owner gets one vote per lot owned. Voting rights are suspended if assessments are unpaid for 15 days (until paid, including interest, legal costs, and attorney's fees) and for up to 60 days for other infractions.
- Assessments & liens: Assessments (annual, supplemental, special) are a personal obligation of the owner and a lien on the lot. The rate is uniform for all lots. Delinquent assessments accrue interest at 6% per annum or the prevailing FHA/VA rate, plus legal costs and attorney's fees. The association may record a lien and foreclose like a mortgage; it may also sue the owner personally.
- Home-based businesses: Properties must be used for single-family residential purposes, but an in-home business or office is permitted if there is no visible manufacturing, assembly, or repair of products visible from outside the home.
- Parking & vehicles: No mobile homes, motor homes, trailers, campers, boats, or trucks with a manufacturer's rating over 1 ton or height over 7'0" (or trucks with camper shells exceeding 6" above the cab) may be parked on streets, driveways, lots, or common areas. Storage of such vehicles is prohibited.
- Trash containers: Trash must be in covered containers approved by the City of Phoenix. Only one container may be visible from neighboring properties (except during collection). No incinerators allowed.
- Landscaping & architectural approval: Planting, landscaping, fences, hedges, or walls on any lot require prior written approval from the Architectural Committee, except for initial construction or areas enclosed by a fence/wall not maintained by the association. Front yard landscaping changes, once approved, are the owner's responsibility for maintenance and do not reduce assessments.
