This is a Declaration of Covenants, Conditions and Restrictions (CC&Rs) for Thunderbird Ranch, a standard single-family home subdivision in Phoenix, AZ. It establishes rules that apply to all lot owners and residents, governing the use, appearance, and maintenance of lots and homes.
- Residential use & minimum house size: Each lot must be used for private dwelling purposes only. No dwelling may be erected with less than 1,500 square feet of floor area, excluding open porches, carports, garages, guest houses or servants' quarters.
- Exterior appearance & colors: Only site-built homes are allowed. Exterior colors must be earth tones, and roof tile colors must match or coordinate with the exterior wall color. Any change in roof color or material after construction requires advance written approval of adjoining lot owners.
- Temporary structures & occupancy: No trailer, tent, shack, garage, barn, or temporary building may be used as a residence. Temporary structures used during construction must be removed immediately after completion (when an occupancy permit is issued).
- Parking & vehicles: Streets must remain clear for traffic. No inoperative motor vehicles (lacking current license plates or not in working order) may be stored or parked on any lot or street.
- Easements & utilities: Public utility easements exist over areas shown on the recorded plat for utilities and emergency access. No structures or plantings may interfere with these easements; lot owners must maintain them. Shared utility connections (water, sewer, electric, etc.) serve multiple lots, and each lot owner has use rights to portions serving their lot.
- Maintenance & damage repair: Each lot owner must maintain all improvements on their lot in a clean and attractive condition. Any restoration or repair of damage to a lot must be done at the owner's expense, unless covered by insurance.
- Enforcement & amendments: Any lot owner may enforce these rules through legal remedies (including lien, injunction, or sale). The Declaration may be amended by an instrument signed by at least 75% of lot owners, recorded to be effective. The Declaration lasts 20 years from recording, then automatically extends for successive 10-year periods unless amended or terminated.
