What Tramonto's governing documents say
Tramonto is a master-planned community in Phoenix, AZ. This Tract Declaration adds specific rules for Parcel E-15, a single-family residential tract with 13 lots (Lots 1-13). It supplements the master Tramonto Declaration and governs custom home construction, landscaping, and assessments. Homeowners and buyers should read both documents.
- Approvals required: All improvements must be approved by the Residential Design Review Committee (RDRC) and the master association board. Additional deed restrictions also need board approval.
- Construction & design requirements: Each home must have at least 2,500 sq ft of livable space (excluding garage/guest house), be single-story (stepped floor levels allowed on slopes; basements allowed), and not exceed 24 feet in height above natural grade (except chimneys). Construction must finish within 18 months of starting grading.
- Landscaping requirement & fines: Front yard landscaping (including irrigation) must be completed within 180 days of starting grading. Violation can result in a $10,000 fine and the association may landscape at the owner's cost, secured by an assessment lien.
- No security gate (with exception): No security gate may be installed at the Tract entrance without Declarant's consent, unless a satellite association of all lot owners is formed to maintain it.
- View impairment disclaimer: No view easements or assurances are granted. Future development of nearby parcels (e.g., Parcel E-1) may obstruct views. Owners are advised to investigate compatibility.
- No further subdivision: Lots cannot be further subdivided without Declarant and master association board approval.
- Memberships & assessments: Each lot receives memberships as per the master Declaration. Annual, special, and special service area assessments are based on the number of memberships per lot.
- What this document doesn't cover: This tract declaration is an addendum to the master Tramonto Declaration. It does not cover common area rules, pet restrictions, leasing terms, parking, or other standard HOA topics found in the master Declaration.
