Vaquero Drive at Gainey Ranch is a single-family residential subdivision within the larger master-planned Gainey Ranch community in Phoenix, AZ. The rules are governed by a sub-association (Vaquero Drive Homeowners Association) and a master association (Gainey Ranch Community Association). This document applies to all lot owners, defining maintenance responsibilities, assessments, and use restrictions.
- Master-planned community structure: The property is subject to both the Vaquero Drive Declaration and the Master Declaration of Gainey Ranch. The Master Association provides administrative, management, and security services, and has the right to take temporary control of the sub-association if needed.
- What you own & maintain: Each owner is responsible for maintaining his or her dwelling unit exterior (including roof, gutters, painting) and the lot (landscaping, walks, etc.). The sub-association maintains common areas (landscaping, streets, recreational facilities) and pays utilities for them.
- Assessments & fees: Regular assessments are set annually by the Board to cover common expenses and reserves. Special assessments for capital improvements require 66% owner vote after turnover. Owners of unimproved lots pay 25% of regular/special assessments until a certificate of occupancy is issued. Delinquent assessments accrue interest at the Default Rate (prime plus 4%, minimum 18%) and create a lien on the lot.
- Architectural review: An Architectural Committee (appointed by the Board) sets design guidelines and must approve all improvements. A processing fee may be required. The committee's rules are binding on owners.
- Security gates: The property has two security gates at entrances. Declarant or the Association (by 2/3 vote) may choose to staff them with guards. Costs are common expenses. All lots participate in the Master Security System.
- Cable television: All owners must pay per-lot cable television charges even if they don't use the service. Charges are set by a master agreement between the Master Association and a provider.
- Use restrictions (general): Lots are for single-family residential use. The Board may adopt rules regulating use of common areas and impose fines for violations. No unlawful uses are permitted.
