This is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) for The Vintage at Gainey Ranch, a single-family home community in Scottsdale, AZ. It is part of the master-planned Gainey Ranch, with a Master Association that provides management services. All owners are automatically members of the homeowners association and must comply with these rules, which run with the land.
- Residential use & business restrictions: All lots must be used exclusively for single-family residential use. No gainful occupation, profession, or trade is permitted on any lot.
- Pets: No more than two dogs or cats may be kept as domestic pets. No animal may create a nuisance, and no pet structures may be visible from neighboring property.
- Leasing & rentals: An owner may lease only the entire lot (not a portion). Leases must be for at least 30 days. All leases must be in writing and subject to the CC&Rs; owners must notify the association and provide the lease term and tenant's name.
- Architectural review: Any exterior improvement, alteration, or landscaping (including buildings, fences, walls, antennas, window coverings, HVAC, solar panels) requires prior written approval from the Architectural Committee.
- Parking & vehicles: No mobile homes, motor homes, trailers, trucks, campers, boats, or similar vehicles may be parked or stored on streets, lots, or common areas. Inoperable vehicles may not be visible from neighboring property. Street parking is allowed only as authorized by the Architectural Committee.
- Assessments: The association levies annual, supplemental, special (capital), and extraordinary assessments. Assessments are a lien on the lot and the personal obligation of the owner. Delinquent assessments accrue interest at 18% per annum and may lead to lien foreclosure.
- Party walls: Walls on lot dividing lines are party walls. Repair and maintenance costs are shared proportionally. Damage caused by an owner's negligence is that owner's sole responsibility. Disputes are resolved by arbitration.
