What North Meadow at Gainey Ranch's governing documents say
North Meadow at Gainey Ranch is a single-family residential subdivision in Phoenix, AZ within the larger Gainey Ranch master-planned community. You own your lot and dwelling unit; the satellite HOA maintains common areas and is subject to oversight by the Master Association, which coordinates community-wide facilities and assessments.
- What you own & maintain: You own your lot and dwelling unit and are responsible for maintaining the exterior (roof, gutters, painting, landscaping, grass, trees, shrubs, walks). The Association maintains common areas, parking, streets, and recreational facilities.
- Landscaping requirements: Landscaping must be installed to Architectural Committee standards within 120 days of initial occupancy (or 180 days after the dwelling unit is substantially complete, whichever is earlier). If you don't comply, the Association can install landscaping at your cost plus interest at the default rate (prime + 4%, minimum 18% per year).
- Assessments, fees & interest: Regular annual assessments cover common expenses (amount set by the Board). Special Assessments for capital improvements require 66% member approval. Unimproved lots pay 25% of regular assessments. All completed units must pay mandatory monthly cable TV charges. Delinquent assessments accrue interest at prime + 4% (minimum 18% per year).
- Golf course adjacency & risk: The property borders a golf course. By purchasing, you acknowledge and accept all risk of golf ball damage to your property or injury to persons, and you waive all claims against the HOA, Declarant, Architectural Committee, and related parties for any golf course–related harm.
- Voting rights & developer control: You have one vote per lot owned. Voting rights are suspended for unpaid assessments or violations. Until 75% of lots are sold to third parties (the Turnover Date), the Declarant holds 10 votes per lot; after Turnover, all owners have equal voting (one vote per lot).
- Architectural review & approval: An Architectural Committee reviews and approves improvements and sets standards (particularly for landscaping). Failure to comply with approved standards can result in the Association taking corrective action at your cost.
- Master Association overlay & additional fees: Your property is subject to the Gainey Ranch Master Declaration and Master Association Documents. The Master Association manages community-wide facilities (golf course, security system, cable TV) and collects separate assessments on top of the satellite HOA fees.
