This is the full Declaration of Condominium for Villa Canelview Condominiums in Phoenix, AZ. It creates a 10-unit condominium regime (Units A–J) and binds all unit owners. As a condo owner, you own your unit and share the common elements; the association maintains the building exterior and common areas. Leases must be for at least 35 days, and no more than two household pets (dogs or cats) are allowed per unit.
- What you own & maintain: You own the interior surfaces of your unit (paint, flooring, fixtures) and are responsible for their maintenance and repair. The association maintains and repairs the exterior walls, roof, common elements (hallways, grounds, carports, amenities), and structural components. Unit owners must keep the interior in good condition and cannot alter exterior appearance without board approval.
- Leasing & rentals: Units may be leased only for a term of 35 days or more. The lease must be in writing, incorporate the declaration and rules, and the lessee (tenant) is bound by all governing documents. Occupancy is limited to the lessee and their family, servants, and guests — no subdividing or short-term rentals.
- Pets: Dogs, cats, and other household pets are allowed in reasonable numbers and must be kept in a manner that does not unreasonably interfere with other owners. No animals, livestock, or poultry may be kept for commercial purposes. Outside clotheslines and visible antennas are prohibited, but concealed satellite dishes may be approved.
- Parking & vehicles: Each unit is entitled to at least two assigned carports (lettered to match the unit). Parking of boats, recreational vehicles, campers, trailers, or commercial trucks requires prior board approval. Disabled vehicles must be removed promptly. No vehicle repairs on driveways or common areas without approval.
- Assessments & fees: Annual assessments are levied uniformly per unit. The initial maximum annual assessment is $729. It may increase up to 5% per year without a vote; any increase above 5% requires a two-thirds vote of owners. Special assessments for capital improvements or extraordinary expenses also require a two-thirds vote. Assessments are a lien on the unit and bear 5% annual interest if unpaid.
- Use & occupancy restrictions: Units must be occupied as a single-family residence (owner, family, servants, and guests). No nuisances, offensive activities, or unlawful uses allowed. No subdivision of a unit. No exterior signs except one 'For Sale' or 'For Rent' sign not exceeding five square feet, location approved by the board. No clotheslines, visible antennas, or structures (sheds, fences) without board approval.
- Alterations & improvements: Nonstructural alterations within a unit may be done without board approval, but the owner is liable for any damage to other units or common elements. Structural changes or any alterations to common elements require prior written board approval. Painting or decorating the exterior of any building is prohibited without board approval.
