What Villa De Coronado's governing documents say
Villa De Coronado is a 14-unit condominium community in Phoenix, AZ — you own your individual apartment and a 1/14th undivided interest in the common elements. The association administers the property, and owners must follow the Declaration and By-Laws. This document is the full rulebook for the community.
- What you own & maintain: You own the interior finished surfaces of your apartment, including walls, floors, and ceilings (plaster, paint, wallpaper), plus your refrigeration and heating unit. You do not own the unfinished surfaces of perimeter walls, floors, ceilings, or utility lines that serve more than one apartment. The association maintains the common elements (land, buildings less apartments).
- Use restrictions: Each apartment may be used only as a private dwelling for the owner, their family, tenants, and social guests. No other purpose is allowed.
- Leasing & rentals: Leases for less than 30 days or that provide customary hotel services (room service, maid, linen, bellhop) are prohibited. Otherwise, owners have the absolute right to lease, subject to the Declaration and By-Laws.
- Right of first refusal: Before accepting an offer to sell, lease, or rent, the owner must give written notice to the Board of Directors. Within 15 days, any association member may submit an identical firm offer to purchase, lease, or rent. If no such offer is made within 15 days, the owner can accept the original offer within the next 60 days.
- Assessments & liens: Each owner must pay regular and special assessments levied by the association. Unpaid assessments become a lien on the apartment, which can be foreclosed like a mortgage. The lien is subordinate to first mortgages. Upon sale of an apartment, the new owner is jointly and severally liable for unpaid assessments up to the time of transfer.
- Insurance & reconstruction: The association carries master insurance. If damage extends to 13 or fewer apartments or any common elements and proceeds are $19,999 or less, the Board contracts for repair. If proceeds exceed $19,999, they are deposited in a bank and a contractor bond is required. If 14 apartments are destroyed, insurance proceeds are held in trust and owners vote on rebuilding. If not rebuilt, the property is withdrawn from the horizontal property regime.
- Easements: Blanket easements exist for utilities (water, sewer, gas, electricity, phone, cable) and for minor encroachments due to construction or settling. Specific utility easements are also reserved.
- What this document doesn't cover: The Declaration does not address pet restrictions, age restrictions, parking rules, architectural review, or specific rental application fees. Those may be covered in the association's By-Laws or separate rules.
