What Yourland Condominium's governing documents say
Yourland Condominium is a condominium community in Phoenix, AZ — you own your individual unit and share ownership of the building's common elements, which the association maintains and insures. The declaration sets out the rights and obligations of unit owners, including assessments, use restrictions, and insurance requirements.
- What you own & maintain: You own your unit and any buildings or improvements within its boundaries. The association maintains all common elements (shared areas) and carries master property and liability insurance. You must maintain your unit and any limited common elements (like utility lines serving only your unit) and are responsible for repair after damage.
- Assessments & fees: Each unit pays regular assessments based on its unit area, with budgets set annually by the board. Special assessments (for capital improvements) require approval by two-thirds of unit votes. The association can levy enforcement assessments for violations, and charge a transfer fee on resales (not on first sales from the declarant).
- Use restrictions: Units may only be used for uses allowed by Phoenix zoning ordinances. No immoral, improper, or unlawful use is allowed, and no nuisance or activity that unreasonably interferes with others' quiet enjoyment. Exterior sound devices (except security) require board approval.
- Insurance: The association maintains property insurance on common elements (at 100% replacement cost) and general liability coverage (minimum $1M per occurrence plus $2M umbrella). You must insure your own unit and improvements, and carry liability insurance. Master policy deductibles are common expenses unless caused by your negligence.
- Enforcement & penalties: The association can impose monetary penalties, suspend voting rights, suspend services for delinquent assessments, exercise self-help after notice, and record a notice of violation against your unit. You are responsible for fines caused by your tenants or guests.
- Developers' rights: Until 90 days after 75% of units are sold to non-declaranant owners (or 4 years after sales stop), the declarants can appoint and remove board members, exercise development rights, and require approval for certain actions.
