Sky Harbor Corporate Center is a commercial/industrial development in Tempe, AZ, governed by a Declaration of Covenants, Conditions, and Restrictions. The developer (Declarants) manages the property until a formal association is formed by majority vote of owners.
- Permitted uses: Property may be developed for any lawful commercial/industrial use, including offices and other commercial uses allowed by zoning. No portion may be used for residential purposes except incidental to watchmen or guards protecting the property.
- Architectural approval: Any construction, alteration, or modification that increases building square footage or affects exterior appearance requires written approval from Declarants (or the Association after Relinquishment). A $500 review fee applies. Requests must be submitted at least 60 days prior; approval is deemed granted if no response within 30 days.
- Maintenance obligations: Each owner must maintain their building and lot in first-class condition, including exterior, signage, parking, striping, paving, landscaping, and utilities. Landscaping must be kept neat and attractive. Drainage facilities and drywells must be maintained; drywells cleaned bi-annually. Owners are responsible for all costs.
- Assessments and fees: Owners pay proportionate share (based on lot square footage) of costs for common area maintenance (landscaping, retention basins), insurance, management fees, and reserve funds. Billed monthly/quarterly; due within 10 days. Delinquent assessments bear 15% annual interest and create a lien on the lot. Transfer fees may also be imposed.
- Easements and access: Non-exclusive easements are granted for ingress/egress over main driveways, utility connections, drainage, construction, and emergency services. Owners may not build walls or barriers that obstruct access. Main driveway locations may be changed by Declarants (or Association after Relinquishment) as long as access is not materially affected.
- Assessments: Owners pay their Ownership Percentage (lot square footage / total lot square footage) of common expenses. Payments due within 10 days of billing; delinquent amounts bear 15% annual interest and become a lien on the lot. Enforcement includes personal action and foreclosure.
- Association formation: After Declarants relinquish control, a majority of Owners may form an association by recorded amendment. The association assumes management, enforcement, and rulemaking powers, but cannot discriminate among owners. Individual owners retain enforcement rights but cannot impose liens without court approval.
