It applies to all lot owners and residents, binding them to the rules, assessments, and restrictions that run with the land. Key features include age restrictions (55+ community), single-family residential use, and detailed architectural and use controls.
- Age restriction (55+): At least 80% of dwelling units must be occupied by at least one person 55 or older; all units must have at least one occupant 40 or older. - Pets: Dogs, cats, and fish may be kept as household pets without prior approval, subject to board rules. All other animals require board approval. Pets must be leashed outside and owners must clean up feces immediately. No dog runs without architectural approval.
- Assessments & fees: The HOA levies annual assessments to cover operating expenses and reserves. The board may increase the maximum annual assessment each year by the actual cost increase or CPI change. Special assessments, transfer fees, and fines may also apply. Assessments are a lien on the lot.
- Construction & improvements: Dwelling units must be at least 950 square feet, no more than one story. Only one detached single-family home per lot plus a garage (max 2-3 cars). All construction must be by licensed contractors, completed promptly, and comply with city codes.
