Pinon Oaks is a single-family residential subdivision in Prescott, AZ, with multiple phases (developed 1999–2003) that have separate CC&R documents. The phases share similar rules for building design and property maintenance but have varying height and setback limits. Lot owners in Unit 3 are required to join the HOA and pay pro-rata assessments for sewer maintenance.
- What you own & maintain: You own your home and lot; you are responsible for property maintenance and landscaping. If a lot is not kept in neat condition, neighbors can arrange cleanup and place a lien on your property for the costs.
- Building requirements & Architectural Committee approval: Single-family detached homes only, tile roof required, minimum 1,800 sq ft floor area. All construction must be approved by the Architectural Committee before you start—submit a plot plan, construction specs, and landscaping plan. In Unit 4 Phase 2, a $500 deposit ($75 non-refundable) is required. Construction must be completed within 8 months of start.
- Height & setback limits (vary by phase): Maximum height ranges from 18–24 ft above the lot's highest elevation. Minimum setbacks also vary: Unit 4 Phase 2 requires 25 ft from front/rear, 7 ft from side. Unit 3 Phases require 30 ft from front/rear, 10 ft from side (corner lots: 15 ft on side street).
- Landscaping, trees & site requirements: A landscaping plan must be submitted within 2–6 months of occupancy/permit and completed within 6–12 months (timelines vary by phase). Natural trees must be preserved; removal requires committee approval. Plastic underlay is prohibited. You must not obstruct or block drainage easements on your lot.
- Pets, vehicles & exterior storage: Dogs and cats are allowed as household pets; they must be on a leash when off your lot. No livestock or poultry. Recreational vehicles, boats, and trailers cannot be parked on the lot unless enclosed in a structure at least 6 feet high and finished to match the house. Garbage must be stored out of sight.
- Fencing, antennas & satellite dishes: Fencing is limited to privacy screening, child containment, or animal control, and requires committee approval; perimeter fences are prohibited. Satellite dishes over 3 feet in diameter require approval and must be hidden from view. Ham radio towers must be approved and lowered from view when not in use.
- HOA membership & sewer assessments (Unit 3): Lot owners in Unit 3 automatically become HOA members and pay annual pro-rata assessments for sewer line operation and maintenance. Invoices are due within 30 days of mailing; unpaid amounts create a lien on your property and can be foreclosed. The association can discontinue sewer service if assessments remain unpaid.
