Prescott Resort is a standard single-family home community governed by a homeowners association (HOA). This Declaration of Covenants, Conditions and Restrictions (CC&Rs) applies to all lot owners and spells out land-use rules, architectural controls, and the association's powers. Living here means your use of the property is subject to HOA approval for exterior changes, and you must pay assessments for common-area maintenance.
- Permitted use & leasing: All lots must be used exclusively for single-family residential purposes. You may lease your entire lot to a single family, but you must give written notice to the board (including lessee names and lease term) and follow any additional board rules.
- Architectural review: Any exterior improvement, alteration, fence, wall, or change in exterior color or materials requires prior written approval from the Architectural Committee. The committee can deny plans for aesthetic reasons, and all decisions are final.
- Maintenance & repairs: Owners must keep their buildings in good repair and adequately painted. If an owner fails to maintain the exterior, the association may step in after 30 days' notice (or immediately in an emergency) and charge the owner for the cost plus interest.
- Parking & vehicles: Only operating automobiles may be parked in uncovered areas; no boats, RVs, trailers, or inoperable vehicles may be kept visible from neighboring property. Carports may not be converted to living space. Street parking by owners is prohibited.
- Animals: Only a reasonable number of common household pets (dogs, cats, etc.) are allowed, kept as domestic pets only. Pets must not create unreasonable noise or nuisance, and any pet structure must not be visible from neighboring property. The board decides what is 'reasonable.'
- Leasing restrictions: No lot may be leased for less than the entire lot (no partial rentals) and only to a single family. Leases require prior written notice to the board. No further subdivision or condo conversion without board approval.
- Assessments & fees: All lot owners must pay annual and special assessments to the association. Assessments are a lien on the property and a personal obligation of the owner at the time they fall due. Delinquent assessments can be enforced via lien and suit, and a lot may not be sold unless all assessments are paid.
- Common area use & restrictions: Common areas are for the benefit of all owners – used for access, parking (temporary, not overnight), and other uses adopted by the board. No storage or overnight parking is allowed on common areas, and activities that spoil appearance or interfere with others are prohibited.
