Willow Lake Estates is a mobile-home subdivision in Prescott, AZ, where you own the lot and place a mobile home on it. The community is governed by a Declaration of Restrictions that creates a homeowners' association (Willow Lake Estates Lot Owner's Association) and sets requirements for the size, condition, and placement of mobile homes, as well as rules for pets, parking, and maintenance. The original developer (The Glenarm Land Co.) initially manages common areas, with control transferring to the association after 50% of lots are sold.
- Use & structures: Lots may be used only for mobile homes. Only one mobile home per lot. Any porch, room, carport, or other construction must be attached to the mobile home (directly or by breezeway) and requires written approval from the developer (and later the association). Mobile homes must have complete sanitary facilities and connect to sewer per health requirements.
- Pets & livestock: No mules, goats, cows, chickens, pigs, or other livestock or fowl allowed. Dogs must be kept on a leash or enclosed in a yard.
- Parking & vehicles: No washing machines or other appliances may be kept outside. Construction machinery, dump trucks, tractors, blades, etc., may not be parked or stored on any lot.
- Maintenance & appearance: All lots must be maintained and kept clean. No trash or garbage except in a buried sanitary container. If the owner fails to maintain, the developer (or association) may do so and charge the owner, creating a lien on the lot.
- Association & assessments: The Willow Lake Estates Lot Owner's Association consists of all lot owners (one vote per lot). Once 50% of lots are sold, management of common areas transfers from the developer to the association. Monthly assessments are levied equally on lot owners to cover common area maintenance and services; unpaid assessments become a lien enforceable like mechanic's liens.
- Covenant duration & amendments: These restrictions run with the land until a termination date (apparently blank in the original), then auto-renew every 10 years. Amendments require agreement of a majority of lot owners and the developer.
