What Orchard Ranchettes's governing documents say
Orchard Ranchettes is a single-family residential subdivision in Queen Creek, Arizona — you own your individual lot and automatically become an HOA member, which maintains common areas, landscape tracts, and equestrian trails through annual assessments. The community was designed to accommodate horses alongside traditional residential living.
- What you own & maintain: You own your individual lot and are responsible for your home, landscaping, and keeping surface water on your property. The HOA maintains common areas, subdivision signage, equestrian trails, and landscape tracts, funded by per-lot annual assessments.
- Building & home requirements: Your home must be a detached single-family dwelling, maximum 2 stories or 30 feet high, with minimum 1,750 sq ft of livable space and 70 feet frontage width. Set-backs required: 45–65 feet from the street, 20 feet from side lot lines, 40 feet from the rear. Garages must have side entrance only, not face the street. All construction requires Architectural Control Committee approval before you begin.
- Horses & livestock: Horses are allowed for your personal use only (not commercial), but only after you receive a Certificate of Occupancy for your home. You must provide at least 100 sq ft of shade per horse and maintain facilities cleanly and to committee approval. Swine, peacocks, chickens, sheep, ducks, and geese are prohibited.
- Pets: You may keep a reasonable number of household pets (dogs, cats, birds, fish) if they stay confined to your lot and cause no nuisance. All pets must be kept in fenced areas, caged, or controlled; they cannot run at large except on leash under your direct control.
- Parking & vehicles: All vehicles must be parked in garages or driveways; inoperable vehicles cannot be visible from neighboring properties. Trailers, campers, boats, and RVs are allowed only in the rear and must be screened from view. No vehicle repairs on the front of your lot; ATVs and motorcycles need committee approval for use on subdivision trails or easements.
- Fencing: Front-yard fencing is restricted to open-style material (white PVC or committee-approved) only. Side yards not adjacent to streets or easements may have solid walls if architecturally matching your home. Livestock fencing must be 3–4 rail metal pipe or PVC, 3'6" minimum to 5 feet maximum height, painted white if metal. All fencing requires committee approval.
- Landscaping: You must obtain committee approval for a detailed landscaping plan before planting. Within 180 days of moving in, plant three 24" box street trees (two citrus, one citrus/carob/ash/elm) in your front yard. Your property must be kept neat and weed-free; if neglected, the HOA can enter, perform cleanup, and bill you for all costs plus a lien.
- Assessments & HOA fees: Annual assessments are levied per lot for common area maintenance and operations. From 1997–1998, the maximum was $300/year; from 1999 onward, can increase annually by 5% or the Cost of Living Index (whichever is greater) without a membership vote. Unoccupied lots pay 25% of the occupied-lot rate. Delinquent assessments accrue 18% annual interest and create a lien; the HOA can foreclose and sell your lot.
