This is the Bylaws of the Queen Creek Ranchettes II Homeowners Association, a standard single-family home HOA in Queen Creek, AZ. The Bylaws govern how the association is run — board elections, meetings, committees, and finances. The actual rules about what you can do with your property (pets, parking, rentals) are in a separate document called the Declaration.
- Board of Directors & governance: A 3-member board manages the association; after developer control ends, all directors must be homeowners. Directors serve 1-year terms. A majority of directors is needed for a quorum, and decisions are by majority vote of those present.
- Architectural Committee: A committee of at least 3 members (no architect required) reviews and decides on proposed changes to lots. The developer appoints the committee until all lots are sold; afterward the board appoints members for 1-year terms.
- Fines & enforcement: The board can impose fines on owners and residents for violating the Declaration, rules, or architectural rules, but only after notice and a hearing. The board can also suspend voting rights and common-area use for up to 60 days per infraction.
- Financial powers & budget: The board prepares an annual budget and can borrow up to $5,000 without homeowner approval; borrowing over $5,000 requires a two-thirds vote of all homeowners. The board also collects assessments and can suspend rights for non-payment after 15 days.
- Membership meetings & voting: Annual meetings are required. A quorum is 10% of total votes. Proxies are allowed (only to another member, secretary, developer, or mortgagee) and expire after 25 months. Special meetings can be called by the president, board, or upon request of 25% of members.
- Amending the Bylaws: Bylaws can be amended by a vote of more than 50% of members present (in person or by proxy) at a meeting. The developer can also amend unilaterally to comply with government or lender requirements, and developer approval is needed for any amendment as long as the developer owns a lot.
