What Ranchos Jardines's governing documents say
Ranchos Jardines is a standard single-family home subdivision in Queen Creek, AZ. These governing documents (Declarations of Restrictions for Units I, IIA, IIB, and a later amendment) set rules for lot use, construction, maintenance, and livestock. The rules apply to all lot owners and are intended to preserve the area as a residential community.
- Residential use & lot restrictions: Lots are for one single-family dwelling only. No resubdivision into smaller lots, except for public utilities. Minimum dwelling size is 1,300 square feet (excl. porches/garages) with a minimum cost of $17,000 (1970s figures).
- Livestock & poultry: Owners may keep up to 4 horses, calves, steers, or sheep per acre (if owning 2+ contiguous acres, 4 per acre). An amendment also removed limits on chickens, ducks, turkeys, etc., allowing unlimited poultry. All must be fenced per county regulations, and enclosures must blend with the neighborhood.
- Fencing & setbacks: Fences must be wood, concrete block, pipe, or chain link (no wire fencing). Max height 6 feet. No solid wall/fence/hedge over 3.5 feet (Unit I/IIA) or 4 feet (Unit IIB) within front setback. Front wall of residence must be at least 40 feet from front lot line, sides 30 ft, rear 40 ft.
- Maintenance & liens: Owners must keep lots clean, including irrigation ditches. If not maintained, the developer or owners' association may step in and charge the owner; unpaid charges become a lien on the property.
- Construction standards: All construction must use new first-class materials. Roofs cannot be tin, aluminum, or steel unless HUD-approved. Exteriors must be finished or natural. Construction must be completed within 12 months of start (barring delays).
- Prohibited activities: No noxious trades, nuisances, dumping, or use of lots as dumps. No hospitals, sanitariums, or lodging for the sick for hire. No hogs, goats, or similar livestock except as allowed for horses/sheep.
- Duration of restrictions: These covenants run with the land and automatically renew every 10 years after the initial term (e.g., Unit IIA until June 1, 1993, then successive 10-year periods) unless a majority of owners vote to change them.
