This is a Declaration of Covenants, Conditions and Restrictions (CC&Rs) for The Pecans, a single-family home HOA community in Queen Creek, Arizona. It governs 55 lots and applies to all owners, residents, and tenants. The HOA is called The Pecans Homeowners Association, Inc. The rules cover everything from design and construction standards to leasing, pets, parking, and assessments.
- Design & Architecture: All exterior changes, including construction, painting, landscaping, and fences, require prior written approval from the Design Review Committee (DRC). Minimum home sizes: 3,200 sq ft for single-story, 3,000 sq ft for two-story. All homes must have at least a 3-car garage, with garage doors not facing the street. Roof materials must be high-quality (e.g., concrete tile, slate); asphalt shingles and wood shakes are prohibited.
- Leasing & rentals: Leases must be in writing, for an initial term of at least one month. No subleasing or assignment. Owners must provide the Association with tenant info and lease terms at least 10 days before occupancy. The owner remains liable for tenant violations.
- Pets: Household pets (cats, dogs, non-exotic) are allowed but cannot be kept for commercial purposes. Pets may not stray onto other lots without the owner's consent.
- Parking & vehicles: Parking only on paved driveways; street parking prohibited except in designated areas. No trailers, trucks, or commercial vehicles allowed overnight. Recreational vehicles, boats, and trailers must be parked inside garages or concealed behind side lot fences on a paved pad. Temporary parking for loading/unloading limited to 24 hours.
- Assessments: All lot owners (except Declarant) must pay assessments. Regular assessments are the same for each assessable lot. Special assessments require approval by two-thirds of member votes and Declarant approval while Declarant owns lots. There are also Interim, Maintenance, Solid Waste Disposal, Irrigation Water, and Remedial assessments.
- Pecan Trees & Landscape: Mature pecan trees are protected. At least 50% of pecan trees on a lot must be retained. Owners must install underground irrigation for retained pecan trees. Landscaping plans require DRC approval, and front yards must be 80% vegetated. Retained pecan trees must be protected during construction.
