What The Quarters at Queen Creek's governing documents say
This document is a supplemental declaration specifically about membership in the Central Arizona Groundwater Replenishment District for The Quarters at Queen Creek (Parcels A and B). It is not a full set of HOA or community rules — it binds all current and future property owners to pay certain groundwater-related fees and assessments to the Central Arizona Water Conservation District (CAWCD). The document runs with the land and creates a lien for nonpayment.
- Groundwater replenishment fees: Each parcel is subject to a Replenishment Assessment (based on groundwater use), a Replenishment Reserve Fee, an Activation Fee, Annual Membership Dues, and an Enrollment Fee, all set by CAWCD. Fees must be paid as described, and CAWCD can charge interest and penalties for late payment.
- Payment timeline for developer fees: The Activation Fee and Replenishment Reserve Fee must be paid by the owner (often the developer) before the state real estate commissioner issues a public report for selling/leasing subdivided land. The Activation Fee may be paid in two installments.
- Lien and personal obligation: Unpaid Replenishment Assessments and Annual Membership Dues automatically become a lien on the parcel, and are also a personal obligation of the owner at the time they came due. CAWCD has legal remedies under Arizona law for nonpayment.
- Amendment requirements: The declaration can be amended only with written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property, or by changes in applicable statutes/regulations.
- Binding effect: All owners and successors are bound by this declaration automatically upon acquiring any interest in the property. The covenants run with the land.
- What this document doesn't cover: This is a partial document focused solely on groundwater replenishment obligations. It does not address typical community rules such as architectural review, leasing restrictions, pet limits, parking, or HOA governance. Those would be found in a separate master declaration or community documents.
