These are the bylaws for Horse Mesa Well Co-Op, a shared well cooperative in San Tan Valley, AZ. This is not a homeowners association—it governs water sharing among property owners (shareholders) who each own shares based on acreage. The rules apply to shareholders, not tenants or renters, and focus on water usage, fees, and maintenance of the well system.
- Membership & shares: Ownership is tied to land: one share per acre, with a total of 20 shares. When property is sold, the share transfers with the acre. Water is only provided to shareholders; shares cannot be sold separately.
- Voting & meetings: Each share gets one vote; a simple majority carries. An annual business meeting is held each January. Special meetings may be called as requested. Votes may be cast in person or by written proxy. Bylaws can be amended at the annual meeting by majority vote.
- Fees & billing: Initial sign-up fee is $500. Monthly water service is $50, paid yearly ($600). Fees are reviewed and adjusted at the annual meeting. Delinquent payments over 60 days go to small claims court; if unpaid, water is disconnected and a $100 fee is added. Yearly statements are sent to each shareholder.
- Water usage restrictions: Water may only be used by shareholders for bona fide domestic purposes. Any excessive usage may be charged extra after a vote. Non-shareholders cannot use the water.
- Repair & maintenance responsibilities: Shareholders must promptly repair leaks in their service line or plumbing. Costs for damage caused by the shareholder or their guests are the shareholder's responsibility. The co-op maintains water lines in easements, except for damage from owners or contractors. Maintenance, replacement, or improvements costing over $500 require majority shareholder approval. If repair costs exceed the well account balance, the overage is divided equally among shareholders.
- Easements & testing: The co-op has established easements for system access and working space. Well testing by local authorities is permitted at the requesting party's expense.
- Non-participating shareholders: Shareholders who have not developed their property and are not using the well still have voting rights but pay a reduced fee of $10 per month, paid yearly, until construction begins on their parcel.
- Sewage disposal restrictions: No element of an individual sewage disposal system may be located or relocated within 100 feet of the well.
