What Chaparral Heights's governing documents say
Chaparral Heights is a single-family residential community in Scottsdale, AZ, governed by a homeowners' association (the Chaparral Heights Owners Association). Every lot owner automatically becomes a member and must follow the covenants, conditions, and restrictions, which cover property use, architectural control, and assessments. The community is part of a larger master-planned development with a master association that also has architectural approval authority.
- Residential use & occupancy: All lots must be used exclusively for single-family residential purposes. No business, trade, or nonresidential use is allowed. Temporary occupancy (trailers, tents, incomplete buildings) is prohibited.
- Architectural review: Any exterior alteration (including color changes, additions, fences, antennas) requires prior written approval from the Architectural Committee. If the committee fails to act within 60 days after complete submission, approval is deemed given. The Master Association's Architectural Committee also has approval authority.
- Pets: Only a reasonable number of customary house or yard pets are allowed, kept as domestic pets only. Pets must be leashed (max 6 ft) when off the owner's lot. Owners must immediately remove pet droppings from other lots. No pet structure may be visible from neighboring property.
- Vehicles & parking: No inoperable vehicles or major repairs visible from streets or neighboring property. Trucks over 3/4 ton, campers, boats, and trailers generally cannot be parked visibly. Pickup trucks under 3/4 ton with camper shells (under 7 ft tall) and mini-motor homes (under 7 ft tall, under 18 ft long) may be parked if used regularly for basic transportation. The association may tow violating vehicles at the owner's expense.
- Assessments: Annual assessments are set by the Board, originally capped at $180 per lot. The cap can increase annually by up to 5% or the CPI increase, whichever is greater, without a membership vote. Increases beyond that require a 2/3 vote of members. Special assessments also require a 2/3 vote. Assessments are a lien on the lot, and nonpayment can lead to foreclosure.
- Signs & antennas: Only one residential identification sign (max 72 sq in) and one 'for sale' or 'for rent' sign (max 5 sq ft) are allowed. Antennas, satellite dishes, and similar outdoor devices require prior architectural approval. No outdoor clotheslines visible from neighboring property.
- Common walls & maintenance: For lots with common walls, each owner shares the right to use the wall. If damaged by an owner's act, that owner must repair. If damaged by other causes, adjoining owners share cost equally. Maintenance of walls on lot boundaries (not common walls) is the owner's responsibility, except the association maintains the side facing common area.
