What La Villita's governing documents say
La Villita is a single-family home HOA in Phoenix, AZ. This document is a 2006 amendment to the CC&Rs that adds a rental prohibition and new leasing rules. It binds current and future owners, but existing rental tenants are grandfathered until the property is sold.
- Rental prohibition & grandfathering: Renting out lots is prohibited. Owners who were renting when the amendment was recorded (2006) may continue renting until the lot is sold to a new owner. The Board may grant temporary exceptions for hardship at its sole discretion.
- Leasing requirements for permitted rentals: Grandfathered leases must be in writing, for a term of six months or more, and include a provision that tenant violations are grounds for eviction. Owners must submit a rental registration form for each new tenant/lease and provide tenants with a copy of governing documents.
